Nussbaum Gleason views appellate advocacy as a distinct area of legal expertise, involving thoughtful selection of the issues for appeal, effective legal briefing, and persuasive oral advocacy. Our lawyer’s served as clerks to some of the nation’s leading appellate judges. We know how appellate courts think. We regularly handle merits disputes before appellate bodies throughout the country.

We represent our clients in appellate proceedings in the U.S. Supreme Court (as amicus counsel), in state courts and supreme courts, and in federal courts of appeals across the country. We also regularly serve as amicus counsel in some of the most important disputes of the day. Nussbaum Gleason recently served as amicus counsel for:

  • Renowned scholar of the First Amendment Stanford Professor Michael McConnell in Carson v Makin, a case challenging Maine’s discrimination against religious schools;
  • The leading public-interest law firm in Colorado, the Public Trust Institute, in 303 Creative v. Elenis, a case challenging the constitutionality of Colorado’s Anti-Discrimination Act; and
  • Citygate Network in Seattle’s Union Gospel Mission v. Woods, a case challenging Washington state’s refusal to allow religious organizations to hire employees who adhere the tenants of the organization’s faith.

We help our clients advocate their beliefs in the public square. With the ever-growing thicket of regulation on speech and beliefs of individuals and entities, we advise businesses, churches, non-profits, and individuals how to protect their rights and advance their causes.

  • We form and structure non-profits, 501(c)(4)’s, advocacy organizations, and associations.
  • We help clients navigate state and federal constitutional and statutory issues, including First Amendment rights, TABOR, parental rights, and other issues.
  • We hold the government accountable to our clients through FOIA and CORA requests and litigation.
